Privacy Policy (Email & SMS)

Data Controller: Ine Forgeron ENVAQ — within the meaning of Regulation (EU) 2016/679 (GDPR) and the amended French Data Protection Act.

1) What data we collect (identity, consent logs, marketing telemetry)
  • Identity & contact: first/last name, email, phone number.
  • Opt-in & preferences: chosen channels (email/SMS), timestamp, source, consent text version, IP address.
  • Marketing usage data: email opens, clicks, bounces, unsubscribes; SMS delivery status, replies (STOP, AIDE).
  • Transactional (where applicable): purchase history, billing, support interactions.
2) Purposes & legal bases
  • Marketing by email/SMSConsent (Art. 6-1-a GDPR). You may withdraw anytime: unsubscribe link (email) or reply STOP to SMS.

3) Recipients & processors

We use providers acting under our instructions (DPAs in place), including Mailgun (sending/telemetry), hosting, analytics, and support platforms.

4) International data transfers

Transfers outside the EEA rely on the European Commission’s Standard Contractual Clauses and, where appropriate, supplementary measures.

5) Retention periods
  • Prospects (marketing data): 3 years from last active contact (click/open/reply).
  • Proof of consent: 5 years (CNIL recommendation) from last send.
  • Opt-outs/unsubscribes: stored on suppression list.
  • Legal documents & invoicing: up to 10 years.
6) Your rights

You may request access, rectification, erasure, restriction, portability, and object to marketing at any time; you may withdraw consent at any time.

7) Email & SMS specifics
  • Email: every message contains an unsubscribe link.

8) Cookies, pixels & measurement

We may use tracking pixels in emails and technical identifiers to measure opens/clicks and improve relevance. You can configure your email client to block such pixels.

9) Security & minors

Security: encryption in transit, access controls, logging, minimization.

Minors: the digital age of consent in France is 15. Our services are not directed to persons under 15 without parental consent.

We may update this policy. The current version appears with the effective date above.

Terms of Use — Email & SMS Program

1) Purpose & sign-up

These terms govern your subscription and use of our electronic communications (email/SMS), including marketing and transactional messages related to your requests/purchases.

  • You subscribe via our forms (website, GHL funnel, pop-up, checkout, SMS keyword, QR code, etc.).
  • By ticking the box and submitting, you consent to marketing via selected channels.
  • You certify that you are 15+.
2) Frequency, content, costs & availability
  • Indicative frequency: up to 4 SMS/month and 8 emails/month (excluding transactional/service messages).
  • Content: offers, promotions, reminders, news, editorial content, surveys, confirmations and service alerts.
  • Costs: we charge no fees; your carrier/ISP may bill data/messaging under your plan.
  • Availability: temporary outages may occur (maintenance, network).
3) Opt-out & help
  • SMS: reply STOP to stop all marketing SMS. For assistance, reply AIDE (HELP) or contact us.
  • Email: use the unsubscribe link in each message.
  • Withdrawal does not affect prior lawfulness; necessary service messages may continue.
4) Your obligations & data
  • Provide accurate information and keep contact details up to date.
  • No abuse (spam, harassment, illegal content); comply with applicable law.
  • Processing is described in our Privacy Policy.
5) Suspension/termination, liability, changes, law
  • We may suspend/terminate if required by law, abuse is detected, your contact is invalid, or you unsubscribe.
  • Service is provided “as is”; delivery is not guaranteed (carrier filtering, spam folders, network). Mandatory statutory liabilities remain.
  • We may change these terms; the current version is posted with the effective date. Material changes may be notified by email/SMS or on the site.
  • Governing law: France; competent courts of our registered address, subject to mandatory rules.
